Final Update July 2023: On July 13, 2023 the Supreme Court Of Canada dismissed the plaintiff's application to have the claim heard by the Supreme Court. Therefore, this specific initiative has come to an end. Further commentary may be found here:

2022 UPDATE: On August 11, 2014 Plaintiffs Ginny and Gwen filed a lawsuit against the FATCA agreement in Federal Court of Canada. See the original Claims

We lost the Federal Court battle (Mactavish decision) and Appellants Gwen and Kazia appealed the Federal Court decision in Canada’s Court of Appeal on
March 30, 2022.

We expect that the Federal Court of Appeal will decide the case in the fall of 2022.

Gwen and Kazia say that the Canadian FATCA turnover to the U.S. IRS of private information of a subgroup of Canadian citizens – made only because of threat of harm by the U.S. – violates Canada's Charter of Rights and Freedoms.
